Terms of Service

By creating a Fabelyn account or using the Fabelyn service ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use Fabelyn.

These Terms form a binding legal agreement between you and Atlian Capital LLC ("Fabelyn," "we," "us," "our").

If you are accepting these Terms on behalf of a family, you represent that you have the authority to bind all family members to these Terms.

2.1 Account Holders

To create a Fabelyn account, you must be:

• ✦At least 18 years of age, OR
• ✦At least 13 years of age with express parental consent (where applicable under applicable law)

2.2 Children's Use

Children under 13 may not create their own Fabelyn accounts. Fabelyn is a parent-facing web app — children receive printed or downloaded coloring books and color on paper. Children do not access the Fabelyn platform directly. By adding a child profile to your account, you represent that you are that child's parent or legal guardian.

2.3 Geographic Availability

Fabelyn is currently available in the United States. We may expand to additional regions. Some features (such as print-on-demand) may have geographic restrictions based on fulfillment partner availability.

3.1 Account Creation

You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the accuracy of your account information.

3.2 Account Security

You are responsible for:

• ✦Maintaining the confidentiality of your password
• ✦All activity that occurs under your account
• ✦Notifying us immediately of any unauthorized use at info@atlian-capital.com

Fabelyn is not liable for any loss or damage arising from unauthorized use of your account.

3.3 One Account Per Family

You may create one Fabelyn account per family. Each account may have up to 4 child profiles (on the Family tier) or 1 child profile (on Explorer and Creator tiers).

4.1 Available Plans

Annual plans are available at a 20% discount. Prices are in USD and subject to applicable taxes. Story length (4, 6, or 8 pages) consumes page credits equal to the page count.

4.2 Billing

• ✦Monthly and annual subscriptions are billed in advance
• ✦Billing is processed through Stripe, our payment processor
• ✦You authorize Fabelyn to charge your payment method on a recurring basis until you cancel

4.3 Free Tier

The Free tier is available to all users without a payment method. Free tier PDF downloads include a small Fabelyn watermark. We reserve the right to modify free tier limits with 30 days notice.

4.4 Cancellation

You may cancel your subscription at any time through your account dashboard (Account → Subscription → Cancel) or by emailing info@atlian-capital.com. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the period ends. We do not offer partial-month refunds.

4.5 Refunds

We offer a full refund if requested within 7 days of initial subscription purchase. After 7 days, subscriptions are non-refundable. Print-on-demand orders cannot be cancelled once sent to production. Contact info@atlian-capital.com for refund requests.

4.6 Price Changes

We will provide at least 30 days notice of any price increases via email and in-app notification. Price increases will take effect on your next renewal date.

5.1 Permitted Uses

You may use Fabelyn to:

• ✦Create personalized coloring stories for children in your family
• ✦Download and print completed stories for personal use
• ✦Order printed books for personal use or as gifts

5.2 Prohibited Uses

You may not use Fabelyn to:

• ✦Create content that is violent, sexual, hateful, discriminatory, or otherwise harmful
• ✦Attempt to circumvent our content safety systems
• ✦Generate content involving real people without their consent
• ✦Generate content that infringes third-party intellectual property rights
• ✦Use the service for commercial purposes without our express written permission
• ✦Resell, sublicense, or distribute access to Fabelyn
• ✦Attempt to reverse engineer, decompile, or otherwise access Fabelyn's underlying systems
• ✦Use automated tools to access the service (bots, scrapers, etc.)
• ✦Impersonate Fabelyn or any other person or entity
• ✦Engage in any activity that could harm Fabelyn's systems or other users

5.3 Content Standards

All story prompts must comply with our Content Standards, which prohibit:

• ✦Sexual content of any kind, particularly involving minors
• ✦Violence, weapons, or threatening content
• ✦Hate speech or discrimination
• ✦Drug or alcohol references
• ✦Content designed to harm or exploit children
• ✦Real personal information about children (names, addresses, school names)
• ✦Copyrighted characters or trademarks

We use automated and human moderation to enforce these standards. Violations may result in account suspension or termination.

6.1 How AI Works in Fabelyn

Fabelyn uses Anthropic Claude for story generation and content safety classification, and OpenAI GPT Image for generating coloring page illustrations.

6.2 Content Accuracy and Quality

AI-generated content may be imperfect. Fabelyn does not guarantee that generated stories will perfectly match your description, that generated images will be consistent across pages, or that generated content will be free of errors. If you receive content that is inappropriate or fails our safety standards, please report it immediately at info@atlian-capital.com.

6.3 Intellectual Property of AI-Generated Content

The intellectual property status of AI-generated content is evolving and legally uncertain. As of the effective date of these Terms:

• ✦Story text generated by our AI based on your prompt may or may not be copyrightable depending on the degree of human creative input.
• ✦AI-generated coloring page images may not qualify for copyright protection in many jurisdictions, including the United States.

You are responsible for understanding and complying with the intellectual property laws applicable to your use of AI-generated content in your jurisdiction.

6.4 Your Rights to Generated Content

Subject to these Terms, you have a non-exclusive, personal license to:

• ✦View and download generated stories and images
• ✦Print generated content for personal, non-commercial use
• ✦Order printed books through our print-on-demand service

You may not use generated content for commercial purposes without our written permission, or in any way that violates applicable law.

7.1 Your Content

You retain ownership of the story prompts and descriptions you submit ("Your Prompts").

7.2 License to Fabelyn

By submitting story prompts, you grant Fabelyn a limited, non-exclusive license to process your prompts through our AI pipeline for the purpose of generating your personalized story. We do not use your prompts to train AI models.

7.3 Fabelyn's Content

Fabelyn owns the Fabelyn platform, technology, and AI pipeline; Fabelyn's branding, design, and trade dress; and our safety systems and prompt engineering.

8.1 Ordering Printed Books

You may order physical printed books of completed stories through Fabelyn's print-on-demand service, fulfilled by Lulu (lulu.com).

8.2 Pricing

Current print pricing is displayed at checkout. Prices include printing, materials, and shipping.

8.3 Production and Shipping

• ✦Processing time: 3–5 business days
• ✦Domestic shipping (US): 5–10 business days after production
• ✦International shipping: 7–21 business days after production

Shipping times are estimates and not guaranteed. Fabelyn is not responsible for carrier delays.

8.4 Cancellation and Returns

• ✦Orders can be cancelled within 24 hours of placement (before sent to production)
• ✦Once in production, orders cannot be cancelled
• ✦Defective or damaged books: contact info@atlian-capital.com within 14 days of delivery for a replacement

Your use of Fabelyn is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and protect information, including children's information under COPPA.

Child Safety: Fabelyn takes child safety extremely seriously. We have implemented a 6-gate content safety system to prevent harmful content from reaching children. If you observe content that you believe is inappropriate or harmful, report it immediately at info@atlian-capital.com.

NCMEC: Fabelyn is legally required to report apparent child sexual abuse material (CSAM) to the National Center for Missing and Exploited Children. We comply fully with this obligation under 18 U.S.C. § 2258A.

10.1 Service Availability

We aim for high availability but do not guarantee uninterrupted access to Fabelyn. The service may be unavailable due to maintenance, outages, or circumstances beyond our control.

10.2 Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of Fabelyn with reasonable notice. We will provide at least 30 days advance notice of material changes that affect core functionality.

10.3 Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of Fabelyn after the effective date constitutes acceptance of the updated Terms.

11.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: the service will be uninterrupted or error-free; AI-generated content will meet your expectations; the service will be free of harmful content (though we make commercially reasonable efforts); or generated content will be accurate or reliable.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FABELYN'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FABELYN IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50.

FABELYN IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR EMOTIONAL DISTRESS, EVEN IF FABELYN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.3 Essential Basis

The disclaimers and limitations above reflect an allocation of risk that is an essential basis of the bargain between you and Fabelyn. Fabelyn would not provide the service without these limitations.

You agree to defend, indemnify, and hold harmless Fabelyn and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• ✦Your use of the service
• ✦Your violation of these Terms
• ✦Your violation of any third-party rights
• ✦Content you submit through the service
• ✦Your violation of applicable law

13.1 Informal Resolution

Before filing any legal claim, you agree to contact us at info@atlian-capital.com to attempt informal resolution. We will have 30 days to respond.

13.2 Governing Law

These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict of law provisions.

13.3 Jurisdiction

Any legal action arising from these Terms must be brought in the courts of Fairfield County, Connecticut, and you consent to the personal jurisdiction of those courts.

13.4 Class Action Waiver

14.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fabelyn regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 No Waiver

Fabelyn's failure to enforce any right or provision of these Terms will not constitute a waiver of that right.

14.4 Assignment

You may not assign your rights or obligations under these Terms without Fabelyn's written consent. Fabelyn may assign its rights without restriction.

14.5 Force Majeure

Fabelyn is not liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, pandemics, internet outages, or third-party service failures.
